From where I’m sitting, the justice system seems to be more interested in investigating poor individuals than rich companies. I can’t think of many modern examples of rich companies (or even people) being held accountable for something that didn’t involve stealing from other rich people.

That being said, I don’t think the issue here is with 404 Media. The majority of news sites operate this way - if people are given the option to donate, 99.9% of them just won’t. Whoever is researching and writing these articles (a team of 4 people by the sounds of it) likely need to eat and pay rent. Personally I feel better about not paying for something like NYT or Washington Post than I do for a smaller and apparently less corrupt site like 404.
